Service Agreement "Read this agreement carefully!" Terms
and Conditions: When submitting videotapes, films, slides or any other media to
Farnsworth Video for either duplication, conversion, repair, video transfer or for
any other reason, customer acknowledges and agrees that Farnsworth Video and any
individual or business affiliated with Farnsworth Video shall not be liable for
any loss or damage to such materials following receipt and during processing of
such materials (even if due to fault or negligence on behalf of Farnsworth Video)
and that the only remedy shall be replacement with a similar amount of blank film/video
tape if attempts to recover or repair media fails. Farnsworth Video makes no other
warranty and assumes no other risk and shall not be liable for any indirect special,
incident or consequential damages resulting from customer's use of Farnsworth Video's
services. This agreement excludes specifically any counter offers by customer including
(without limitation) statements of value in excess of replacement cost of a similar
amount of videotape or requests for special handling. Customer warrants that the
videotape, film, photos, slides or other media submitted to Farnsworth Video for
processing is not protected by a third party copyright owner or if protected, the
customer has obtained permission of such third party copyright holder to make copies.
Customer also agrees to protect and indemnify Farnsworth Video (or it's assignees)
from any costs related to copyright infringement. I grant permission and authorize
Farnsworth Video to use my project media for advertising, promotions, and sales
without permission, royalties or any other form of compensation. If product destination
is DVD media, then I understand that the end DVD Product may not be compatible with
my intended DVD Player. Farnsworth Video is responsible for the Digitizing of the
product and will demonstrate on Farnsworth Video DVD Players that the service has
been performed correctly. I understand that it is my own responsibility to verify
whether or not the intended DVD player is compatible. If I am not sure whether my
DVD Player is compatible or not, I can ask the Farnsworth Video to check their DVD
Player compatibility listing. Farnsworth Video DVDs work in 99.9% of all commercial
DVD Players. GUARANTEED.
Agreed Services: Farnsworth Video will display/demonstrate-finished product on standard
digital DVD equipment. This display/demonstration verifies completion of the agreed
services. Farnsworth Video is not responsible, if in the event that the customers
own DVD equipment is not capable of displaying the finished product. Demonstration
of finished product confirms that your DVD product was successfully digitized and
can be viewed on most standard DVD players. Farnsworth Video provides NO REFUNDS.
No Exceptions. If we agree with your disatisfaction we will reprocess your
project at no extra cost; or an additional cost if the project requires more processing
than origally agreed to. The quality of the your project media has a direct correlation
to the quality of service that Farnsworth Video can provide for you. If your
source materials are of poor quality, you should reasonably expect your project
to reflect this. If you are not aware of the quality of your films, it is
your responsiblity to advise Farnsworth Video of your wishes to proceed with the
processing. For example, if the film is very bad. do you want Farnsworth Video to
stop processing. You should be aware that we are unable to determine quality
until we transfer it.
